BETA TERMS OF USE

Welcome to Trust the Tribe. These Beta Terms of Use ("Terms") are a legally binding agreement between you and Trust the Tribe LLC, a limited liability company organized under the laws of the State of Delaware ("Trust the Tribe," "we," "us," or "our"). By creating an account, clicking to accept these Terms, or otherwise accessing or using the Trust the Tribe beta application, website, services, features, content, or related products (collectively, the "Service"), you agree to be bound by these Terms and by our Privacy Policy, which is incorporated into these Terms by reference.

If you do not agree to these Terms, do not use the Service.

IMPORTANT: SECTION 18 OF THESE TERMS CONTAINS A BINDING ARBITRATION AGREEMENT AND CLASS ACTION WAIVER THAT AFFECT HOW DISPUTES BETWEEN YOU AND TRUST THE TRIBE ARE RESOLVED. PLEASE READ IT CAREFULLY.

1. BETA PROGRAM

The Service is a limited beta release and is provided solely for evaluation, testing, and feedback purposes.

The Service may contain bugs, errors, interruptions, security vulnerabilities, incomplete features, or other defects. Features may be modified, suspended, or discontinued at any time without notice.

The Service is provided on an "AS IS" and "AS AVAILABLE" basis.

Participation in the beta program is by invitation or at Trust the Tribe's discretion. Trust the Tribe may limit the number of participants, suspend or end the beta program, or transition the Service to a general release at any time, and may require you to accept updated terms in order to continue using the Service.

2. ELIGIBILITY

You must be at least 18 years of age to use the Service. The Service is intended for users located in the United States and is not directed to children.

By using the Service, you represent and warrant that:

  • You are at least 18 years old.
  • You have the legal authority to enter into these Terms.
  • You are not prohibited from using the Service under applicable law and have not previously been suspended or removed from the Service.
  • All information you provide is accurate and complete.

3. USER ACCOUNTS

Account Registration and Guest Access. While certain features of the Service are accessible to visitors without an account, you must register to access the Service's full functionality.

Guest Access (No Account Required). Without creating an account or signing in, visitors may: View the public Home feed of product recommendations, including merchandised sections (e.g., seasonal picks) and the "Shop All" product grid. View publicly available product details, including product name, image, price, retailer link, category, and aggregated insights or reasons shared by members with public profiles. Click through to a third-party retailer's website to view or purchase a product (all purchases occur on the third-party retailer's site and are subject to that retailer's terms and conditions). View the public profile pages of members who have opted to make their profiles public, including their first name, general location, number of children, and shared products. View public "Ask the Tribe" requests and read the recommendations contributed by members. View general community statistics and featured-member highlights. Access informational pages, including these Terms of Use and our Privacy Policy.

Registered Access (Account Required). You must create an account to access features including, but not limited to: saving products, sharing products with friends, following users, chatting with other members, posting or answering an "Ask the Tribe" request, using the AI question search, adding products to a closet, connecting an email inbox for purchase import, and managing profile settings or notifications.

Registration Methods. You may register with an email address and password or through a third-party sign-in service such as Google. If you sign in through a third-party service, you authorize Trust the Tribe to receive the account information that service makes available (such as your name, email address, and profile picture), and your use of that service is subject to its own terms and privacy policy.

You are responsible for:

  • Maintaining the confidentiality of your login credentials.
  • Restricting access to your account.
  • All activities occurring under your account.

You agree to immediately notify Trust the Tribe of any unauthorized use of your account. Your account is personal to you and may not be shared, sold, or transferred to anyone else. Trust the Tribe is not liable for any loss or damage arising from unauthorized use of your account.

4. USER CONTENT

You may submit product recommendations and the reasons behind them, product links, photos (including photos of products and your profile picture), requests for recommendations, comments, reviews, lists, messages to other users, profile information, and other content (collectively, "User Content").

You retain ownership of your User Content.

However, by submitting User Content, you grant Trust the Tribe a worldwide, non-exclusive, perpetual, irrevocable, royalty-free, sublicensable, and transferable license to use, host, store, reproduce, modify, adapt, publish, display, distribute, analyze, and otherwise utilize such content for purposes related to operating, improving, marketing, and developing the Service, including displaying your User Content together with your name and profile picture to other users and using your User Content to create Aggregated Data (as defined in Section 11).

Trust the Tribe has no obligation to store, maintain, or return User Content, and may, but is not obligated to, review, monitor, edit, or remove User Content at any time for any reason, including content that Trust the Tribe believes violates these Terms.

The Service may use artificial intelligence tools to identify products from photos you upload, to suggest product links, or to draft the reasons for a recommendation. Any suggestion that you review, edit, or approve becomes part of your User Content, and you are solely responsible for confirming that it is accurate and reflects your own opinion before you submit it.

You represent and warrant that:

  • You own or have the right to submit the content.
  • Your content does not infringe or violate any third-party rights, including intellectual property, privacy, or publicity rights.
  • Your recommendations reflect your honest opinions and your actual experience with the product.
  • You will clearly disclose any material connection you have with a product, brand, or retailer you recommend (for example, if you received the product for free, were paid to promote it, or sell it), as required by the Federal Trade Commission's Endorsement Guides.
  • Your content does not include personal information about, or identifiable images of, any other person, including any child, without that person's consent or, in the case of a child, the consent of the child's parent or guardian.
  • Your content is accurate to the best of your knowledge.

5. ACCEPTABLE USE

You agree not to:

  • Create fake accounts.
  • Submit fraudulent recommendations.
  • Manipulate rankings or engagement metrics.
  • Post misleading, deceptive, or false information.
  • Upload malicious code or software.
  • Scrape, copy, or extract data from the Service.
  • Use bots, automation, or scripts without authorization.
  • Interfere with operation of the Service.
  • Harass, threaten, bully, or impersonate any person, or misrepresent your affiliation with any person or entity.
  • Post or collect personal information about other users without their consent.
  • Use the Service, including its request, messaging, or invitation features, to send spam, unsolicited commercial messages, or invitations to people who have not agreed to receive them.
  • Use the Service for any commercial purpose, including advertising, promoting, or selling products or services, or recommending products in which you have an undisclosed financial interest, without Trust the Tribe's prior written consent.
  • Circumvent, remove, or alter any affiliate link, tracking code, or referral mechanism used by the Service.
  • Reverse engineer, decompile, or attempt to discover the source code of the Service.
  • Post content that is unlawful, defamatory, obscene, hateful, or that promotes violence or discrimination.
  • Violate any applicable law or regulation.

Trust the Tribe reserves the right to investigate suspected violations, remove User Content, and suspend or terminate any account at its sole discretion, with or without notice.

6. PRODUCT RECOMMENDATIONS AND THIRD-PARTY RETAILERS

Trust the Tribe facilitates recommendations generated by users. Recommendations reflect the personal opinions and experiences of individual users, not those of Trust the Tribe.

Trust the Tribe does not independently verify, endorse, certify, test, or guarantee:

  • Any product.
  • Any retailer.
  • Any recommendation.
  • Any review.
  • Any product's safety, suitability for a particular age or child, or compliance with applicable safety standards or recalls.
  • Any user-generated content.

Users are solely responsible for evaluating products and making purchasing decisions, including confirming that a product is safe and appropriate for their family and checking for product recalls or safety notices.

Trust the Tribe does not sell products and is not a party to any transaction between you and a retailer. Any purchases made through links or recommendations are made directly with the third-party retailer, are subject to that retailer's terms, policies, and privacy practices, and are conducted entirely at the user's own risk. Trust the Tribe is not responsible for the availability, pricing, shipping, returns, quality, or safety of any product, or for the content or practices of any third-party website.

Metrics displayed on the Service (such as views, saves, shares, or purchases) are based on activity recorded within the Service, including clicks on retailer links, and do not confirm that a purchase was actually completed.

7. AFFILIATE LINKS AND COMPENSATION DISCLOSURE

Trust the Tribe participates in affiliate marketing programs and networks. This means that when you click a product link on the Service and make a purchase from a retailer, Trust the Tribe may earn a commission or other compensation from that retailer or affiliate network, at no additional cost to you.

Affiliate compensation does not influence which products users choose to recommend. Trust the Tribe does not currently accept payment from brands or retailers to feature, rank, or promote products on the Service. If Trust the Tribe later introduces advertising or sponsored content, any such placement will be clearly identified as advertising or sponsored, will be kept separate from members' organic recommendations, and these Terms and the Privacy Policy will be updated as needed before those features launch. Affiliate relationships do not create any endorsement, warranty, or guarantee by Trust the Tribe of any product or retailer.

Affiliate links may use cookies or tracking codes provided by the retailer or affiliate network to attribute purchases. Please see our Privacy Policy for more information.

8. COMMUNICATIONS AND INVITATIONS

By creating an account, you agree to receive communications from Trust the Tribe and from other users through the Service, including emails about requests for recommendations from other members of the community, activity relating to your recommendations, messages, and Service updates. You may opt out of non-essential emails through your account settings or the unsubscribe link included in those emails. Trust the Tribe may still send you administrative messages relating to your account or these Terms.

The Service allows you to invite other people to join by entering their email address and to follow other users. When you invite someone, Trust the Tribe will send an invitation email on your behalf that may include your name. You represent that you have that person's permission to provide their email address to Trust the Tribe and that, to your knowledge, they are at least 18 years old. Trust the Tribe uses invitee email addresses only as described in our Privacy Policy.

The Service includes messaging features that allow you to chat with other users. Messages are stored on the Service, and Trust the Tribe may access, review, and remove messages in order to operate the Service, provide support, enforce these Terms, protect users, or comply with law. Do not share sensitive personal or financial information through the Service.

You consent to receive notices and other communications from Trust the Tribe electronically, including by email and by postings on the Service, and you agree that electronic communications satisfy any legal requirement that such communications be in writing.

9. CONFIDENTIALITY OF BETA PROGRAM

The Trust the Tribe beta program contains confidential and proprietary information.

You agree not to disclose, publish, reproduce, distribute, share, copy, or publicly discuss any non-public aspects of:

  • Product features
  • Product functionality
  • User experience
  • Screenshots
  • Business strategy
  • Technical architecture
  • Beta testing results

without prior written permission from Trust the Tribe.

This obligation does not restrict you from inviting others to join the Service, from sharing your own User Content, or from discussing information that has become publicly available through no fault of yours.

10. FEEDBACK

You may voluntarily provide suggestions, comments, ideas, feature requests, or feedback.

You agree that:

  • Trust the Tribe may freely use and disclose any feedback for any purpose, without restriction or attribution.
  • No compensation is owed.
  • No ownership rights are created.
  • Trust the Tribe may incorporate feedback into current or future products.

11. PRIVACY AND DATA

Our Privacy Policy describes how Trust the Tribe collects, uses, and shares personal information in connection with the Service. By using the Service, you acknowledge that Trust the Tribe may collect information including:

  • Profile information
  • Location information
  • Household information (such as the number of children in your household and their birth month and year)
  • Product recommendations
  • Searches
  • Clicks
  • Saves
  • Shares
  • Usage behavior
  • Photos you upload
  • Purchase information you choose to import from a connected account (such as your email account)
  • Messages, requests for recommendations, and invitations
  • Device information

Such information may be used to:

  • Operate the Service
  • Improve recommendations
  • Analyze platform activity
  • Develop new features
  • Measure engagement
  • Create Aggregated Data (as described below)
  • Support marketing and business operations

Additional information regarding data collection and usage is described in the Trust the Tribe Privacy Policy, which is available on the Service.

Aggregated Data. Trust the Tribe may create and use data that has been aggregated, de-identified, or anonymized so that it does not identify you or any other individual ("Aggregated Data"), including insights about shopping trends, product preferences, and the reasons users recommend products. You agree that Trust the Tribe exclusively owns all Aggregated Data and may use, license, sell, and share Aggregated Data with third parties for any purpose, including commercial purposes, during and after your use of the Service. Trust the Tribe does not sell personal information that identifies you.

Connected Accounts. If you choose to connect a third-party account, such as your Google account, to import purchase information, you authorize Trust the Tribe to access and use the data you select for the purpose of providing the Service's features. Trust the Tribe's use of information received from Google APIs adheres to the Google API Services User Data Policy, including its Limited Use requirements. You may disconnect a connected account at any time through your account settings or through the third-party service.

Profile Visibility. Certain profile information, such as your name, photo, location, and the ages of your children, may be displayed to other users to build trust within the community and to personalize recommendations, depending on the visibility choices you make in your profile settings. Please review those settings carefully before adding any information you do not want other users to see.

12. INTELLECTUAL PROPERTY

All software, designs, trademarks, logos, content, functionality, and intellectual property associated with Trust the Tribe remain the exclusive property of Trust the Tribe and its licensors.

Subject to these Terms, Trust the Tribe grants you a limited, non-exclusive, non-transferable, revocable license to access and use the Service for your personal, non-commercial use during the beta program. The Trust the Tribe name and logo are trademarks of Trust the Tribe LLC and may not be used without our prior written consent.

No rights are granted except as expressly stated in these Terms.

13. COPYRIGHT COMPLAINTS

Trust the Tribe respects the intellectual property rights of others and responds to notices of alleged copyright infringement that comply with the Digital Millennium Copyright Act. If you believe that content on the Service infringes your copyright, please send a written notice to Trust the Tribe's designated agent at the contact information in Section 22 that includes:

  • Identification of the copyrighted work you claim has been infringed.
  • Identification of the material you claim is infringing and information sufficient to locate it on the Service.
  • Your name, address, telephone number, and email address.
  • A statement that you have a good-faith belief that the use of the material is not authorized by the copyright owner, its agent, or the law.
  • A statement, made under penalty of perjury, that the information in your notice is accurate and that you are the copyright owner or are authorized to act on the owner's behalf.
  • Your physical or electronic signature.

Trust the Tribe may remove or disable access to content that is alleged to be infringing and may terminate the accounts of users who repeatedly infringe the intellectual property rights of others.

14. TERMINATION

Trust the Tribe may suspend, restrict, or terminate access to the Service at any time, for any reason, with or without notice.

You may stop using the Service at any time and may request deletion of your account by contacting Trust the Tribe at the address in Section 22.

Upon termination:

  • Your access rights cease immediately.
  • Trust the Tribe may delete account information and content.

Sections 4, 9, 10, 11, 12, and 15 through 21 of these Terms, and any other provisions that by their nature should survive, will survive termination.

15. DISCLAIMER OF WARRANTIES

TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICE IS PROVIDED "AS IS" AND "AS AVAILABLE."

TRUST THE TRIBE DISCLAIMS ALL WARRANTIES, INCLUDING:

  • MERCHANTABILITY
  • FITNESS FOR A PARTICULAR PURPOSE
  • NON-INFRINGEMENT
  • ACCURACY
  • RELIABILITY
  • AVAILABILITY

TRUST THE TRIBE DOES NOT WARRANT THAT THE SERVICE WILL BE UNINTERRUPTED, SECURE, OR ERROR-FREE.

TRUST THE TRIBE MAKES NO WARRANTY REGARDING ANY PRODUCT, RETAILER, USER CONTENT, THIRD-PARTY WEBSITE, OR AI-GENERATED SUGGESTION MADE AVAILABLE THROUGH THE SERVICE. SOME JURISDICTIONS DO NOT ALLOW THE EXCLUSION OF IMPLIED WARRANTIES, SO SOME OF THE ABOVE EXCLUSIONS MAY NOT APPLY TO YOU.

16. LIMITATION OF LIABILITY

TO THE MAXIMUM EXTENT PERMITTED BY LAW, TRUST THE TRIBE, ITS MEMBERS, MANAGERS, OFFICERS, EMPLOYEES, CONTRACTORS, AFFILIATES, LICENSORS, AND REPRESENTATIVES SHALL NOT BE LIABLE FOR:

  • INDIRECT DAMAGES
  • INCIDENTAL DAMAGES
  • SPECIAL DAMAGES
  • CONSEQUENTIAL DAMAGES
  • EXEMPLARY DAMAGES
  • LOSS OF PROFITS
  • LOSS OF DATA
  • LOSS OF BUSINESS OPPORTUNITY

ARISING FROM OR RELATED TO THESE TERMS, THE USE OF OR INABILITY TO USE THE SERVICE, ANY USER CONTENT, OR ANY PRODUCT PURCHASED OR RETAILER ACCESSED THROUGH THE SERVICE, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT TRUST THE TRIBE HAS BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.

IN NO EVENT SHALL TRUST THE TRIBE'S TOTAL LIABILITY FOR ALL CLAIMS ARISING OUT OF OR RELATING TO THESE TERMS OR THE SERVICE EXCEED ONE HUNDRED U.S. DOLLARS ($100).

THE LIMITATIONS IN THIS SECTION APPLY EVEN IF ANY LIMITED REMEDY FAILS OF ITS ESSENTIAL PURPOSE. SOME JURISDICTIONS DO NOT ALLOW THE LIMITATION OR EXCLUSION OF LIABILITY FOR CERTAIN DAMAGES, SO SOME OF THE ABOVE LIMITATIONS MAY NOT APPLY TO YOU.

17. INDEMNIFICATION

You agree to defend, indemnify, and hold harmless Trust the Tribe LLC and its members, managers, officers, employees, contractors, affiliates, successors, and assigns from and against any claims, liabilities, damages, losses, costs, expenses, and reasonable attorneys' fees arising from:

  • Your use of the Service.
  • Your User Content.
  • Your violation of these Terms.
  • Your violation of applicable law.
  • Your infringement of third-party rights.
  • Fraudulent, deceptive, or unlawful conduct.

Trust the Tribe reserves the right to assume the exclusive defense and control of any matter subject to indemnification by you, in which case you agree to cooperate with Trust the Tribe in asserting any available defenses.

18. DISPUTE RESOLUTION; BINDING ARBITRATION; CLASS ACTION WAIVER

Informal Resolution. Before filing a claim against Trust the Tribe, you agree to first contact Trust the Tribe at the address in Section 22 with a written description of the dispute and to attempt in good faith to resolve it informally for at least thirty (30) days. Trust the Tribe agrees to do the same before filing a claim against you.

Binding Arbitration. Except as provided below, any dispute, claim, or controversy arising out of or relating to these Terms or the Service that cannot be resolved informally shall be resolved through binding, individual arbitration rather than in court, except where prohibited by law. The arbitration will be administered by the American Arbitration Association ("AAA") under its Consumer Arbitration Rules, and the Federal Arbitration Act governs the interpretation and enforcement of this Section. The arbitrator will have exclusive authority to resolve any dispute relating to the interpretation, applicability, or enforceability of this arbitration agreement. Any in-person hearing will take place in Westchester County, New York, unless the parties agree to proceed remotely, and judgment on the arbitrator's award may be entered in any court of competent jurisdiction.

Exceptions. Either party may bring an individual claim in small claims court if the claim qualifies, and either party may seek injunctive or other equitable relief in court to protect its intellectual property rights or to stop unauthorized use of the Service.

Class Action Waiver. YOU AND TRUST THE TRIBE AGREE THAT EACH MAY BRING CLAIMS AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE PROCEEDING. Users waive the right to participate in class actions, class arbitrations, or representative actions. If this waiver is found to be unenforceable as to a particular claim, that claim must be brought in court rather than in arbitration, and the remainder of this Section will continue to apply.

Jury Trial Waiver. If for any reason a claim proceeds in court rather than in arbitration, YOU AND TRUST THE TRIBE EACH WAIVE ANY RIGHT TO A JURY TRIAL.

Opt-Out. You may opt out of this arbitration agreement by sending written notice to Trust the Tribe LLC, PO Box 109, Ardsley, NY 10502-0109, within thirty (30) days after you first accept these Terms. Your notice must include your name, the email address associated with your account, and a statement that you wish to opt out of arbitration. Opting out will not affect any other provision of these Terms.

19. GOVERNING LAW AND VENUE

These Terms shall be governed by and construed under the laws of the State of New York, without regard to conflict of law principles. Subject to Section 18, any claim that is not subject to arbitration shall be brought exclusively in the state or federal courts located in Westchester County, New York, and you consent to the personal jurisdiction of those courts.

20. CHANGES TO TERMS

Continued use of the Service after updates constitutes acceptance of the revised Terms. If you do not agree to the revised Terms, you must stop using the Service.

21. GENERAL PROVISIONS

Entire Agreement. These Terms, together with the Privacy Policy and any other policies referenced in them, constitute the entire agreement between you and Trust the Tribe regarding the Service and supersede any prior agreements or understandings.

Severability. If any provision of these Terms is held to be invalid or unenforceable, that provision will be enforced to the maximum extent permitted by law, and the remaining provisions will remain in full force and effect.

No Waiver. Trust the Tribe's failure to enforce any provision of these Terms will not be considered a waiver of its right to enforce that provision or any other provision in the future.

Assignment. You may not assign or transfer these Terms or your account without Trust the Tribe's prior written consent. Trust the Tribe may assign these Terms without restriction, including in connection with a merger, acquisition, reorganization, or sale of assets.

No Agency. Nothing in these Terms creates any partnership, joint venture, employment, or agency relationship between you and Trust the Tribe, and you are not entitled to any compensation for your User Content, recommendations, or participation in the beta program.

Force Majeure. Trust the Tribe is not liable for any delay or failure to perform resulting from causes beyond its reasonable control.
